Unprecedented encroachments on Basic Liberty.  Very important information I never heard before, including the legal meaning of the Military Commissions Act of 2006.
Congressman David Wu (D-OR) stated in the debate over the bill on the floor of the House of Representatives that "by so restricting habeas corpus, this bill does not just apply to enemy aliens. It applies to all Americans because, while the provision on page 93 has the word 'alien' in it, the provision on page 61 does not have the word 'alien' in it."

Let us say that my wife, who is here in the gallery with us tonight, a sixth generation Oregonian, is walking by the friendly, local military base and is picked up as an unlawful enemy combatant. What is her recourse? She says, I am a U.S. citizen. That is a jurisdictional fact under this statute, and she will not have recourse to the courts. She can take it to Donald Rumsfeld, but she cannot take it across the street to an Article 3 court.

Military Commissions Act Does Affect US Citizens
Recent application of terror legislation proves American citizens not exempt from intent of bill

This important series (Recommended downloads below) is about a legal witchhunt against an attorney who specializes in civil rights (Lynne Stewart was facing 30 years on some trumped-up garbage), but it's really about a witchhunt against ALL lawyers fighting for freedom and for people, especially against totalitarianism and witchunts.
This series is also about the War on Terror, about the fraud of "Security" concerns, and the newest "Great Leap Forward" of the "Security State" [Michael Parenti]  i.e. "National Security State" as contrasted with the Democratic Government seen on TV.

Here's some info on some organizations that could have had "absolutely no involvement" with 9-11:  CIA only works freelance when it comes to murder, narco-dealing, and stuffing their pockets, like with Operation Phoenix and the Nugan-Hand bank.  But CIA really works for Wall Street and wealthy elites.  An operation of this caliber with global repercussions and the implemention of an interlocking global "security state" with new domestic security structures of DHS and Northcom and more, all this is too big to have been cooked up BY "the CIA" or other black ops for their own purposes.
  • The first characteristic of a National Security State is that the military is the highest authority. In a National Security State the military not only guarantees the security of the state against all internal and external enemies, it has enough power to determine the overall direction of the society. In a National Security State the military exerts important influence over political, economic, as well as military affairs.
  • A second defining feature of a National Security State is that political democracy and democratic elections are viewed with suspicion, contempt, or in terms of political expediency. National Security States often maintain an appearance of democracy. However, ultimate power rests with the military or within a broader National Security Establishment.
  • A third characteristic of a National Security State is that the military and related sectors wield substantial political and economic power. They do so in the context of an ideology which stresses that "freedom" and "development" are possible only when capital is concentrated in the hands of elites.
  • A fourth feature of a National Security State is its obsession with enemies. There are enemies of the state everywhere. Defending against external and/or internal enemies becomes a leading preoccupation of the state, a distorting factor in the economy, and a major source of national identity and purpose.
  • A fifth ideological foundation of a National Security State is that the enemies of the state are cunning and ruthless. Therefore, any means used to destroy or control these enemies is justified.
  • A sixth characteristic of a National Security State is that it restricts public debate and limits popular participation through secrecy or intimidation. Authentic democracy depends on participation of the people. National Security States limit such participation in a number of ways: They sow fear and thereby narrow the range of public debate; they restrict and distort information; and they define policies in secret and implement those policies through covert channels and clandestine activities. The state justifies such actions through rhetorical pleas of "higher purpose" and vague appeals to "national security."
  • Finally, the church is expected to mobilize its financial, ideological, and theological resources in service to the National Security State.

The first big fish of Mil Comm 2006:

Ali Saleh Kahlah al-Marri is a citizen of Qatar who was arrested while studying in the United States.

Al-Marri was arrested in December 2001, and held in civilian jails in Peoria, Illinois and New York City as a material witness. His brother, Jarallah al-Marri was captured in January 2002, and transported to military detention at United States Guantanamo Bay Naval Base, in Cuba.

In 2002 Ali was charged with financial crimes. Al-Marri was charged with opening bank accounts with inadequate or forged identity documents.  (wow, that could be really bad stuff -- let's say we fry him without a trial)

Evidence has been disclosed that al-Marri was in possession of a telephone card that was previously used to call a number in Dubai linked to the reputed Al Qaeda finacier, Mustafa al-Hawsawi. After searching al-Marri's computer, a folder was found labeled "jihad arena", which according to the government, contained information on hydrogen cyanide, a poisonous gas used in chemical weapons, along with lectures by Osama bin Laden and a cartoon of planes crashing into the World Trade Center.

OK, so I have no idea if al-Marri is a "good guy" a "bad guy" or what.  He probably hates all Jews, including me, for all I know.
But look at the charges they might execute him for:
  • information on hydrogen cyanide, a poisonous gas used in chemical weapons  -  yeah, every bleach and ammonia bottle has warnings about mixing them
  • lectures by Osama bin Laden - How many people have downloaded and watched them?
  • cartoon of planes crashing  - OMG, I even have cartoons of Bin Laden with Bert!!  Plus, everyone's seen that hoax of the guy standing on the (closed) observation deck as the plane flies in.
  • Opening up a bank account with fake ID, they already dropped that charge anyhow.
  • He had a phone card that someone (perhaps al-Marri or his brother) used to call a phone number in Dubai, linked to a guy and that guy might have sent money to some organization that might have helped finance Al-Qaeda.  Maybe he called, maybe he didn't call. 
  • Check this, I have the phone number of a person who funded Al-Qaeda:  202-467-5410
  • Here's another phone number of some people who gave Al-Qaeda lots of cash and weapons:  (703) 482-0623.
  • Here's a phone number of a group that gave an Al-Qaeda member high level training, weapons, and a uniform:  1-800-USA-ARMY
Let's be clear.  The bad thing 's not that they are tracking a potential terrorist.  The point is, before Sept 11, FBI agents were obstructed and thwarted (by superiors) from even seeking a search warrant against suspected terrorists (from Ashcroft, for example), and even theatened against pursuing leads into terrorist financing, by both Clinton and Bush admins.  Now, they want to lock people up indefinitely -- foreign and American -- and ultimately kill them without even a trial in front of Judge or Jury, if an appointed Mil Commission deems it.  This is more than overkill.  This was systematic, when you tie together the old "terrorist-aiding" rules with the new infinite crackdown.

On Jose Padilla

Federal prosecutors and defense lawyers are locked in a tug of war over the relevancy of Mr. Padilla’s military detention to the present criminal case. Federal prosecutors have asked the judge to forbid Mr. Padilla’s lawyers from mentioning the circumstances of his military detention during the trial, maintaining that their accusations could “distract and inflame the jury.”

Mr. Padilla’s status was abruptly changed to criminal defendant from enemy combatant last fall. At the time, the Supreme Court was weighing whether to take up the legality of his military detention — and thus the issue of the president’s authority to seize an American citizen on American soil and hold him indefinitely without chargeswhen the Bush administration pre-empted its decision by filing criminal charges against Mr. Padilla.

Mr. Padilla was added as a defendant in a terrorism conspiracy case already under way in Miami. The strong public accusations made during his military detention — about the dirty bomb, Al Qaeda connections and supposed plans to set off natural gas explosions in apartment buildings — appear nowhere in the indictment against him. The indictment does not allege any specific violent plot against America.

Mr. Padilla is portrayed in the indictment as the recruit of a “North American terror support cell” that sent money, goods and recruits abroad to assist “global jihad” in general, with a special interest in Bosnia and Chechnya. Mr. Padilla, the indictment asserts, traveled overseas “to participate in violent jihad” and filled out an application for a mujahedin training camp in Afghanistan.

AS LONG AS YOU'RE NOT DOING ANYTHING WRONG, YOU HAVE NOTHING TO WORRY ABOUT
I found this article particularly interesting because I have recently returned from vacation.  Right after the election I decided to get away for a while.  I went to the airport just as I had done hundreds of times (having been a management consultant, a marketing manager and a sales representative for the last 25 years).  But this time my trip to the airport was different.  I was not permitted to check in at the curb. I could not check in at the kiosk.  I was told I had to see "the agent".  That's when I was informed that I am on "the watch list".  The "watch list", in case you are not familiar with it, is a list of names of individuals suspected of posing "a risk of air piracy or terrorism or a threat to airline or passenger safety."  While initially denying to the media that such a list existed, the TSA finally acknowledged its existence in October 2002.

I frankly knew nothing about the "watch list" or the TSA. The TSA is the Transportation Security Administration -- it is part of Homeland Security!  Being on the "watch list" is not quite as bad as being on the no-fly list.  Being on the watch list means you are simply delayed 45 minutes while airport security checks you out, you miss your flight because you only arrived an hour early and everyone looks at you wondering if you're about to blow up the place.

As soon as I got to my hotel I looked into trying to get off the "watch list".  I was given a web site and told about the list of information I would have to supply.  On my way home I chatted with the security agent as I went through the process again and told him how I was now going through the necessary procedures to get off the "watch list".  He said I shouldn't go to all that trouble since, although they tell you can get off the watch list after 60 days from the time of application, you never really get off the "watch list".  Let me tell you how wonderful this makes me feel.  Is it fascism yet?

Torture?  Nothing new.  Interesting article if you were born recently and didn't know America went far beyond mere Abu Gharaib-style torture in the past.   Some excerpts:

During the hearings, U.S. Representative Ogden Reid said, "if the Union had had a Phoenix program during the Civil War, its targets would have been civilians like Jefferson Davis or the mayor of Macon, Georgia."
 
But the American establishment and media denied it then, and continue to deny it until today, because Phoenix was a genocidal program

The US Army leaked Abu Gharaib on CNN.  WHY?  Sure it was ugly, bad, wrong.  But why did they leak it?  And you see, it was clearly not as bad as this Phoenix program, yet Abu Ghariab "blew up" bigger in the media ---- despite a vastly more mendacious LYING media.
The answer to that question seems to scream "psychological operations (mindfuck) on Americans".

Unearthed: Fatal Secrets When a wave of torture and murder staggered a small U.S. ally, truth was a casualty. Was the CIA involved? Did Washington know? Was the public deceived? Now we know: Yes, Yes and yes.

The intelligence unit, known as Battalion 316, used shock and suffocation devices in interrogations. Prisoners often were kept naked and, when no longer useful, killed and buried in unmarked graves.

Newly declassified documents and other sources show that the CIA and the U.S. Embassy knew of numerous crimes, including murder and torture, committed by Battalion 316, yet continued to collaborate closely with its leaders.

There was nothing sophisticated about the torture employed by Battalion 316. In addition to la capucha - a piece of rubber cut from an inner tube that prevents a person from breathing through the mouth and nose - they used rope to hang victims from the ceiling and beat them, and extension cords with exposed wires for shock torture.

Gloria Esperanza Reyes, now 52, speaking in an interview at her home in Vienna, Va., describes how she was tortured with electric wires attached to her breasts and vagina. "The first jolt was so bad I just wanted to die," she said.

Jose Barrera, a former battalion torturer interviewed in Toronto, recalls such pleas from prisoners. "They always asked to be killed," he said. "Torture is worse than death."
